tiny villages there are casting the first election day votes in the nation. in the first minutes of voting, president obama and republican mitt romney each had five votes in dixville notch. in harts location, obama received three votes, romney received nine. at the live desk, melissa mollet, news 4. >> reporter: good morning, aaron. what we can expect is a very busy day at the polls. this is a presidential year. turnout is always good. we also have a hotly contested u.s. senate race, and we're one hour before the polls open. you can see we already have a small line forming here at this polling place in alexandria. are you looking to beat the crowds here this morning? >> i did beat the crowds this morning. >> reporter: you're the first in line. >> i am. been here since 4:30 this morning. >> reporter: what's your strategy? were you a little worried about what's ahead in terms of lines?

is >> yes. i have two kids, and they're off from school today. so i had to get out early. >> reporter: and you are. you're number two in line. >> i'm thankful. >> reporter: and it's chilly out here. certainly, you're going to want to bundle up before you head out to the polls. virginia is one of those battleground states that we've heard so much about. president obama won the old dominion four years ago, but mitt romney is pushing back hard. the latest polls show president obama ahead by one point, but it's unclear exactly who is going to take virginia. that poll is well within the margin of error. really who takes the old dominion is going to depend likely on the organization? who gets out the vote? who gets out the base voters to the polls today? the other big race in virginia is the u.s. senate race. hotly contested. there are two familiar faces, two former virginia governors, democrat tim kaine and republican george allen. allen previously held the seat but lost to jim webb in 2006. webb is retiring.

so we have, again, another hotly contested race here. advice to folks here from election officials all around the region, best advice is to come really early or come in the middle of the day. we typically see the biggest crowds, the longest lines, right as people are headed out to work and right after they return from work. so really either very early, like we're seeing right now, or 10:00 a.m. until 4:00 p.m. those are the best times to hit the polls if you're looking to avoid the long lines. reporting live from alexandria, megan mcgrath, news 4. back to you. you have the chance to decide on two ballot measures today. one issue is the amount of time the general assembly can delay the start of a veto session. if the measure passes, lawmakers can delay the start up to one week. the other involves eminent domain. the proposed amendment would allow companies to take someone's home or land only if it's for public use.

organizations would not be allowed to take land if it plans to make money off the property, like a'shoi shopping center or parking garage. voters have big decisions to make outside the presidential election in maryland. three issues on the ballot. one of the most publicized, question 7, would allow table games in the state and a sixth casino to be built in prince george's county. no less important and potentially the most historic is question 6. it asks voters to either approve or reject the legalization of same sex marriage passed by state law plakers earlier this year. if approved, maryland would become the first state in the nation to have voters make the final call to legalize gay marriage. four other states are also casting ballots on the issue today. >> and finally, there is question 4, also known as the d.r.e.a.m. act. it would allow undocumented immigrants to get in state college tuition if they meet residency and other tax requirements.

d.c. will vote on three home rule charter amendments. all three related to d.c. council members ethics. question 5 asks vote erds if the d.c. council should have the power to expel a member for, quote, gross misconduct. the council would have to have five-sixths majority to do so. question 6 would require anyone convicted of a felony to leave office, and that person would be banned from ever serving in office again. question 7 would apply the same penalties to the city's mayor. virginia polls open in less than an hour from now. virginiians can vote between 6:00 a.m. and 7:00 p.m. you need a valid form of i.d. to cast your vote. in maryland, polls open at 7:00 a.m. and close at 8:00 tonight. i.d. requirements there depend on where you're voting and whether you're a first time voter. you can find out more on our website, nbcwashington.com, check out the online voting guide. check out the top right hand corner on the voting page. a week after sandy

devastated seaside communities in new jersey, one of them is asking residents to leave again because of a coming nor'easter. brick, new jersey, issued a mandatory evacuation order for residents in low lying areas. the national weather service says that community will get more than an inch of rain and wind gusts as strong as 55 miles an hour. about 75,000 people lived there. as of last night, utility companies looking to restore power to about 12,000 residents. this morning more than 1 million people remained without power. most of the outages in new york and new jersey. so far sandy claimed at least 106 lives. 12,000 people are living in shelters across seven states. the gas shortage is still a problem, but there are some signs of progress. fuel is being shipped in. the staten island ferry and 80% of the subway systems are up and running. and the u.s. department of agriculture is sending more than 1 million pounds of food to new york.

it is finally election day. here's what you need to know before you head out to the polls. all voters in virginia and first time voters in maryland will be required to show some form of identification. there are at least 30 forms of valid i.d., including an i.d.

card from your employer. it does not have to be a photo i.d. election officials in d.c., maryland, and virginia agree the best time of day to avoid long lines at the polls between 10:00 a.m. and 4:00 p.m. >> we anticipate that people will -- that there will be a large volume of people as we start the day off in voting, but we definitely think that that will calm down by noon. >> and don't forget polls opening and closing times vary from state to state. virginia opens at 6:00 a.m. d.c. and maryland open at 7:00 a.m. if you are not sure about the questions on your ballot, make sure to check out our voting guide at nbcwashington.com. the battleground state getting the most attention this election has to be ohio. it won't necessarily be the state that decides the presidential race. virginia could end up being a

scale. the white states on this map are still considered a toss-up according to nbc news. there are scenarios where it all comes down to the commonwealth. if the president, for example, wins nevada, and he wins iowa, and he wins pennsylvania, and mitt romney then wins colorado, new hampshire, and florida, that leaves three toss-ups. that's wisconsin, ohio, and virginia. if the candidates split ohio and wisconsin, that leaves virginia. and that could be the key to reach the 270 electoral votes needed to win. and the final nbc news/wall street journal poll has the candidates in a statistical dead heat in that race. apparently, today's election will not be the big talk around the water cooler today in our office. really nice job, eun. >> are you laughing at me? >> no. that was well done. about two-thirds of american workers say they don't share

and for dinner at z-burger, you can get a free burger for wearing your i voted sticker. if it's fallen off, say z-vote to the cashier. check out this terrifying video from north texas. three people are lucky to be alive after this close call of a small engine plane clips the top of an suv right there. it's about to land. a flight instructor who works out of the airport says both the driver and pilot are to blame. he says the driver did not follow a stop sign, and the pilot was coming in too low. >> i think it probably should be marked. obviously, they knew they were going to the airport. that was the attraction for them to come out here. so they should have looked before they crossed the runway. he's looking on down the runway a little too low on his approach. i think he should have been a little higher on the approach. >> this was a pilot's first solo flight. he was about a month away from getting his pilot's license, but he's now given up flying completely. a trainer is dead after

being mauled by a bear in montana. he worked at a facility that trained animals for movies. he was reportedly cleaning the bear's enclosure when one of the animals attacked him on sunday. police say there were no defensive wounds on hands or arms and did not use the bear spray he was attack. investigators say he may have fallen and hit his head before being killed. he did die of bite and claw wounds that hit his major arteries. anne arundel county police have quite a surprise waiting for them when they made a drug bust inside his home. they discovered a three-foot alligator. they raided a home on glean eagle drive in jessup. they found the gator along with close to half a pound of marijuana with a street value of $3,100. police arrested michael golden and charged him with intent to distribute illegal drugs. >> it is 5:21. time for weather and traffic on the ones. >> storm team 4 meteorologist tom kierein is here. first widespread freeze of the season all across maryland, virginia, into west virginia.

metro trains stopped running an hour earlier than they were supposed to. that left a lot of folks in the cold late at night wut a way to get home. metro issued a statement apologizing to customers for the inconvenience. 5:20 now. in news 4 your health, the department of health is responsible for a co-worker responsible for an outbreak of hepatitis c. police arrested a medical technician for tampering with needles and infected more than 30 people at the baltimore va medical center. the patient was not hospitalized for the infection and has survived. congress will hold hearings next week to learn more about the deadly meningitis outbreak. the commissioner of the food and drug administration will testify before both houses of congress. a new england compounding center is linked to the deadly outbreak. the outbreak is responsible for 419 reported infections and 30 deaths across 19 states, including two deaths in virginia and one in maryland. men, listen up. taking a multivitamin may not do

anything to help your heart. that's according to a new study by brigham women's hospital in boston. researchers followed 14,000 middle aged male doctors over a decade. half took multivitamins, but after the study, those men showed no difference in the rate of heart disease. the men who took multivitamins did, however, have an 8% lower rate of cancer than those that did not take the vitamins. we spend roughly one-third of our lives in the bedroom. so it is no surprise that, when things aren't healthy there, our whole lives can be affected. doctors say your bedroom should be a sanctuary, a relaxing place to let your mind and body recover. one way to make that happen, remove all the clutter and electronics like tvs, computers, and even digital clocks. get them out of the bedroom. >> everything out of the room. make it really simple. all of a sudden, they can breathe better. >> dr. wiser says another helpful tip is keep the room very dark and don't forget to wash your sheets and pillows at least once a week in hot water.

not finished, that he wants to continue for another four years. iowa, of course, gave him a big victory four years ago and really catapulted his campaign to victory in 2008. meantime, governor romney last night wrapped things up in new hampshire, where he won a big victory earlier this year. governor romney saying he was surprised himself. it was a huge crowd, 12,000 people packed in an arena with thousands more outside last night. those were their final messages. but these were their final messages to ohio. >> this is not just a choice between two candidates or two parties. it's a choice between two different visions of america. >> this is an exciting time, and your voices are being heard all over the nation, and they're being heard loud and clear and into my heart. >> reporter: now, it wouldn't be an election day if we didn't mention tiny dixville notch up in northern new hampshire. they voted just after midnight.

for the first time ever in their voting history, they had a tie. five people voted for president obama. five people voted for governor romney. >> maybe a sign of things to come. tracie potts live in cincinnati for us. tracie, thank you. there are three major referendum questions on maryland's ballot today. we want to make sure you know exactly what those questions are going in today. here's a look at them. questions 4, 6, and 7. we're going to start here with question 7 on expanding gambling. it is basically asking you two things that you want to be thinking about. first, do you think the state's casinos should be allowed to have table games? quite simply, that is the question. here is question number two. do you think a casino should be built in prince george's county, raising the number in the state from five to six? you answer both questions for or against at one time. then there is the next question six on the same-sex marriage issue. it's already been passed into law, but it needs approval from voters to be fully enacted.

here you are either for or against the law. couple of quick details. the law allows gay and lesbian couples to get a marriage license and allows religious institutions to decide if they will perform ceremonies for those couples. finally, there is question four for you to consider, the d.r.e.a.m. act as it's known. a law that makes illegal immigrants eligible for in-state tuition at four year colleges provided they pay taxes, have permanent residency, and complete a certain number of credit hours. >> another question on the maryland ballot was inspired by a corruption scandal in prince george's county. it was spear headed after former council executive leslie johnson was convicted. initially, she refused to resign from office.

eventually, she did step down. the question is a politician will automatically step down from office after be pleading guilty. kwame brown resigned from the council back in june after admitting he gave false information on applications to obtain two bank loans worth more than $200,000. voters will cast their ballots for d.c. council member phil mendelson or democratic challenger calvin gurley. the winner will complete brown's term which runs through january 22nd, 2013. that means another race will take place in 2014. senate candidates tim kaine and george allen will vote right after polls open. kaine and his wife will vote in richmond. allen and his wife are casting their vote in alexandria and will travel to several precincts in the commonwealth.

important. as you mentioned just a moment ago, we have three very important ones we're going to talk about. the first one here, question four, the maryland d.r.e.a.m. act. that's going to tell whether undocumented students will pay in-state tuition if they have graduated high school here in maryland and their parents pay action at that taxes. that was a senate bill pass the in 2011. the next question, question six, civil marriage protection act. that's going to allow gay and lesbian couples to get married. back in march, governor martin o'malley signed a bill legalizing that. opponents fired back very quickly in june. they got a petition going with enough signatures to put it on the november ballot. here they are voting tooday on that. maryland, question seven, the gaming expansion, will that expand commercial gaming in maryland? it's supposed to go to education. it will allow the video lottery

facility in prince george's county. these are very, very important in maryland. this poll is set to open at 7:00 a.m. also, tom, you mentioned the weathers and how cold it is. you were here when we got here at 5:30. you were one of the first ones in line. you were here last year. why is it so important you got here this early? >> i was here in 2008. the line wrapped around. we're excited. there's a lot of issues at hand. no matter how cold it is, we're here. we're here to vote for the issues and support the president. >> thank you for your time. these polls here in prince george's county open at 7:00 a.m. we're waiting for the county executive to come out here at 6:00 a.m. to meet some of the voters. we're going to stay on top of this all morning long. we'll check in with you, eun and aaron, as soon as they show up. back to you. it is now 5:48. reports of voter fraud this morning in key swing states, including virginia. voting rights advocates say

in new jersey, one of them is asking residents to leave their homes again because of the upcoming nor'easter. brick, new jersey, issued a mandatory evacuation order for residents in low lying areas. the community will get more than an inch of rain and wind gusts as strong as 55 miles per hour. about 75,000 people live there. as of last night, utility companies were still working to restore electricity to about 12,000 residents who lost power from sandy. at 5:51 is, let's turn right to storm team 4 meteorologist tom kierein on both the storm coming our way and the frigid cold we had to deal with this morning. >> starting off cold, better news for the new jersey coast and new york city area with the nor'east nor'easter. it does look like it's going to be tracking farther east. it is cold. the coldest morning, widespread freeze of the season. all around the region, down into the 20s thankfully. we don't have much wind at all. the only places above freezing are right on the tidal potomac and right on the bay. as we take a look at what's

happening over the next several hours, we have just a few clouds passing in from the west. these clouds in southern virginia, the carolinas, the leading edge of the coastal storm that is still taking shape. it's all associated with a spin on the midlevel of the area producing some rain. does look like that system yesterday and the day before does look like it's going to track right near the coast is going to be farther out to sea. as a result, the impacts will be much smaller for us. let's break it down hour by hour here. tuesday to 3:00 p.m. we'll still have quite a bit of sunshine as the storm does begin to form off the atlantic coast. it will rapidly deepen and bring some rain and wind along does look like the eastern shore, shoreline may have gusts 40 to 50 miles an hour with chilly rain. this is 5:00 tomorrow morning. during the day on wednesday, we'll have that precipitation pushing west, meeting some cold air, changing over with a little wet snow here in this lavender

zone. parts of the northern and eastern shore, maybe around the bay. generally, the precipitation remains east of i-95. this is the position as of 1:00 on wednesday afternoon. then wednesday evening it does look like a lot of that precipitation changing over to a little wet snow, probably not much accumulation on the eastern shore. then it moves away and tracks up toward eastern new england rather than towards the jersey coast and the new york city area. storm team 4 four-day forecast will be chilly. after that storm goes by wednesday, we will dry out and have sunshine each day thursday through the weekend with a warming trend all the way into veterans day observed on monday. danella, good morning. how's traffic? >> good morning. right now checking on a couple issues in virginia. first let's start with route 1, richmond highway at central avenue. one lane gets by in both directions because of the accident in that area. police and fire on the scene. shooting over to gainesville, still seeing prince william parkway closed at balls ford
